It’s ASB Awareness Week and our final success story. This one ends in the eviction of the resident. Eviction will always be a last resort, but the safety and well-being of our community comes first.

 

We received reported of persistent noise nuisance and anti-social behaviour affecting the living conditions of a number of residents. 

 

We issued them with a noise monitoring app to record the disturbances. The evidence confirmed the complaints were valid.

 

We issued the perpetrator a tenancy warning and the team began the process of seeking a Civil Injunction Order.

 

The court granted the Order, which prohibited specific disruptive behaviours and set expectations for the resident’s behaviour.

 

Despite the ruling, noise complaints continued. We held meetings with the resident, numerous court appearances took place and further junction were obtained. Meanwhile our local residents patiently continued to gather further evidence.

 

Eventually the legal process allowed us to take possession of the property and due to the resident's sustained breaches of the Injunction Order and tenancy conditions, they were evicted.

 

Eviction will always be a last resort, but the safety and well-being of our community comes first.
